1. DATA CONTROLLER. DATA PROTECTION OFFICER.

The Data Controller is FC nolo Srl, with registered office at via Parigi 11, ROME 00185 (RM) – Italy (hereinafter the “Controller”). The Data Protection Officer can be contacted at the e-mail address info@velecharter.it for information on Data processing.

2. CATEGORIES OF DATA.

The Data processed by the Controller includes: (i) personal data (first name, last name, age, gender), data on professional training (qualification, registration number in the register), address of residence or domicile and contact details (telephone, email address).

3. PURPOSE AND LEGAL BASIS OF PROCESSING. LEGITIMATE INTEREST.

The Data will be processed to analyze traffic on the site, pursuant to art. 6, paragraph 1, letters b) and c) of the GDPR, as well as for the pursuit of the Data Controller's legitimate interest, under art. 6, paragraph 1, letter f of the GDPR, with reference to:

 

  1. promotion of its own catamaran charter business with skipper (holiday weeks), nautical franchising (purchase of the boat and affiliation in the Velecharter circuit), and skipper school;

  2. the sending of commercial and promotional communications relating to the services marketed by the Data Controller, as well as surveys and research reserved for subjects who have previously expressed interest in the actions of the Data Controller.

In any case, the processing of your Data carried out on the basis of the Data Controller's legitimate interest takes place, in addition to compliance with the provisions of art. 6, paragraph 1, letter f of the GDPR, also in accordance with Recital no. 47 and Opinion no. 6/2014 Article 29 Data Protection Working Party, par. III.3.1.

4. METHODS OF PROCESSING.

Your Data is collected and recorded lawfully and fairly for the purposes indicated above and is also processed with the aid of electronic and automated tools, including by entering and organizing it in databases, in accordance with the provisions of the GDPR regarding security measures, and, in any case, in such a way as to ensure the security and confidentiality of the Data itself.

5. RECIPIENTS OR CATEGORIES OF RECIPIENTS.

The Data may be made accessible, brought to the attention of, or communicated to the following subjects, who will be appointed by the Data Controller, as the case may be, as data processors – whose list is available at the Data Controller's office – or persons in charge:

  • sales representatives, employees and/or collaborators of any kind of the Data Controller;

  • public or private entities, natural or legal persons, that the Data Controller uses for the performance of activities instrumental to achieving the above-mentioned purposes or to whom the Data Controller is required to communicate the Data by virtue of legal or contractual obligations.

In any case, the Data will not be disclosed.

6. RETENTION PERIOD.

The Data will be retained for a period of no more than 10 (ten) years for informational purposes and, in any case, for the time strictly necessary to pursue the legitimate interest of the Data Controller.

7. RIGHTS OF ACCESS, ERASURE, RESTRICTION, AND PORTABILITY.

The Data Controller informs you that you are entitled to the rights set out in Articles 15 to 20 of the GDPR. By way of example, by sending a specific request to the email address info@velecharter.it, you may:

 

  1. obtain confirmation as to whether or not personal data concerning you are being processed;

  2. if processing is taking place, obtain access to the data and information relating to the processing, as well as request a copy of the data itself;

  3. obtain the rectification of inaccurate data and the completion of incomplete personal data;

  4. obtain, if one of the conditions provided for in Article 17 of the GDPR exists, the erasure of the Data concerning you;

  5. obtain, in the cases provided for by Article 18 of the GDPR, the restriction of the processing of Data concerning you;

  6. receive the Data concerning you in a structured, commonly used and machine-readable format and request their transmission to another controller, if technically feasible.

8. RIGHT TO OBJECT.

Pursuant to Article 21 of the GDPR, you will also have the right to object at any time to the processing of your Data carried out for the pursuit of the Data Controller's legitimate interest by writing to the email address info@velecharter.it. In the event of an objection, the Data will no longer be processed, unless there are legitimate reasons to proceed with the processing that override the interests, rights, and freedoms of the data subjects, or for the establishment, exercise, or defense of a legal claim in court.

9. RIGHT TO LODGE A COMPLAINT WITH THE SUPERVISORY AUTHORITY.

The Data Controller also informs you that you may file a complaint with the Italian Data Protection Authority if you believe that your rights under the GDPR or any other applicable regulation have been violated, according to the procedures indicated on the website of the Italian Data Protection Authority accessible at: www.garanteprivacy.it.
